Terms of Use

Welcome to Capipi! These Terms of Use ("Terms") explain the rules for using the Capipi iPhone app and the website capipi.com (together, the "Service"). Please read them. By downloading or using Capipi, you agree to these Terms. If you don't agree, please don't use the Service.

Our Privacy Policy explains how we handle your data and is part of these Terms.

1. Who we are

The Service is provided by Cristiano Soares de Moraes, an individual (pessoa física) based in São Paulo, Brazil ("we", "us", "our"). Contact: crismoraes.work@gmail.com.

2. What Capipi is

Capipi is a self-care companion with a baby capybara. You complete light daily goals, your Capipi gains energy and grows, you earn oranges 🍊 for outfits and furniture, and you can connect with friends. The essentials are free: caring for your Capipi, goals, friends and reminders. Capipi Plus is an optional paid subscription (section 6).

We keep improving Capipi, so features may be added, changed or removed over time.

3. Capipi is not medical care

Capipi is not a medical, psychological or therapeutic service, and it doesn't provide diagnosis, treatment or professional advice. Goals, messages and suggestions in the app are general self-care encouragement. They don't replace a doctor, psychologist or other qualified professional.

If you're going through a difficult time, please reach out to a professional. If you're in crisis or thinking about harming yourself, contact your local emergency services right away. In Brazil, you can call the CVV at 188 (free, 24 hours) or SAMU at 192.

4. Who can use Capipi

Capipi is not directed to children under 13. If you're under 13, please don't use it. If you're under 18 (or under the age of majority where you live), use Capipi only with the knowledge and permission of a parent or guardian, who also agrees to these Terms on your behalf, including for any purchase.

6. Capipi Plus (auto-renewable subscription)

6.1 What's included

Capipi Plus currently includes exclusive outfits and furniture, +50% oranges from goals, and support for an app with no ads. Special seasons are planned for the future. Plus benefits are available while your subscription is active, and they may change over time as we improve the app.

6.2 Plans and price

Capipi Plus is an annual auto-renewable subscription sold through the Apple App Store. The price, billing period and any free trial are shown in the app and on the App Store before you confirm the purchase. Prices may vary by country and may include taxes, according to Apple's rules.

A founder price may be offered only during onboarding, in the launch phase. It applies to that subscription for as long as it keeps renewing without interruption. If the subscription ends and you subscribe again later, the price then shown in the App Store applies.

6.3 Free trial

Some plans include a free trial (the length is shown before you subscribe). If you don't cancel at least 24 hours before the trial ends, the trial automatically turns into a paid subscription and your Apple Account is charged the price shown. If you allow notifications, the app reminds you 2 days before your trial ends. Any unused part of a free trial is forfeited when you buy a subscription, where applicable.

6.5 How to manage or cancel

You can manage or cancel your subscription at any time in iPhone Settings → [your name] → Subscriptions → Capipi, or from the Manage subscription option in the app. When you cancel, Plus stays active until the end of the period you've already paid for, and it won't renew.

Deleting the app or your Capipi account doesn't cancel your subscription. Only Apple can stop the billing, so please cancel in Settings.

6.6 Refunds

All payments are processed by Apple, and refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com. We can't issue refunds directly, but if something went wrong, write to us and we'll help however we can. Nothing in these Terms removes refund or withdrawal rights you have under applicable consumer law, including the Brazilian Consumer Defense Code (CDC, Law No. 8,078/1990).

6.7 Restoring purchases

If you change phones or reinstall Capipi, you can restore an active subscription with the same Apple Account by tapping Restore purchases on the Capipi Plus screen.

7. Oranges and virtual items

Oranges 🍊, outfits, furniture, decorations, rewards and other virtual items are part of the game. They are earned in the app and have no cash value. You receive a limited, personal, non-transferable license to use them inside Capipi. You can't sell, transfer or exchange them for money, and we won't refund or redeem them for money, except where the law requires it. Virtual items and balances are lost if your account is deleted, and we may rebalance the in-game economy (for example prices in oranges or rewards) to keep the game fair and fun.

10. Intellectual property

Capipi, the Capipi character, Mr. Devagarindo, Cururu, the swamp, the artwork, texts, sounds and software belong to us or our licensors and are protected by law. We give you a personal, limited, non-exclusive, non-transferable and revocable license to use the app on Apple devices you own or control, for personal, non-commercial use, under these Terms and the App Store's Usage Rules. Nothing in these Terms transfers ownership of any of this to you.

12. Suspension and termination

You can stop using Capipi and delete your account at any time.

We may suspend or close an account, or remove a name, if it seriously or repeatedly breaks these Terms, puts other people or the Service at risk, or if the law requires it. When reasonable, we'll let you know first and explain why, so you can respond. If you paid for Plus and we close your account without a valid reason, you may be entitled to the remedies provided by law.

We may also discontinue the Service. If we do, we'll try to give reasonable advance notice in the app or on capipi.com.

13. Availability and disclaimers

We work hard to keep Capipi running and your Capipi safe, but the Service is provided "as is" and "as available". It may sometimes be unavailable, have bugs, or need maintenance. We don't promise that Capipi will reach any particular well-being result.

14. Limitation of liability

To the extent permitted by law, we are not liable for indirect damages, lost profits, or losses caused by events beyond our reasonable control, by third-party services (such as Apple, your carrier or your internet connection), or by misuse of the Service in breach of these Terms.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including your rights as a consumer under the Brazilian Consumer Defense Code (CDC) and the mandatory consumer protection laws of the country where you live, or liability for intent (dolo) or gross negligence.

15. Changes to these Terms

We may update these Terms as Capipi evolves or the law changes. We'll publish the new version here with a new effective date. If the changes are significant, we'll also let you know in the app before they take effect. If you keep using Capipi after that, the new Terms apply. If you don't agree, you can stop using the Service, cancel your subscription and delete your account at any time.

16. Governing law and courts

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the City of São Paulo, State of São Paulo, have jurisdiction, except that, if you are a consumer, you may bring a claim in the courts of your own domicile (CDC art. 101, I). If you live outside Brazil, you also keep any protections given by the mandatory laws of your country of residence.

Before going to court, please write to us. Most issues can be solved quickly and kindly. You can also contact the consumer protection agency where you live (in Brazil, your local Procon).

17. General

If any part of these Terms is found invalid, the rest remains in effect. If we don't enforce a provision right away, that doesn't mean we've waived it. You can't transfer your rights under these Terms without our consent.
